Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website tfwi.co.uk ("the Website") and any services provided by The Free Website Initiative ("TFWI," "we," "us," or "our"). By accessing or using our Website or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.

Please read these Terms carefully before submitting an application or engaging with any of our services.

2. The Free Build Service

TFWI builds one free, professionally designed website for a selected UK business each calendar month. The following terms apply to this service:

  • Selection: Recipients are selected at random from eligible applications. Submission of an application does not guarantee selection.
  • Eligibility: The free build service is available to UK-registered businesses, sole traders, and not-for-profit organisations that do not currently have a functioning, professional website.
  • Scope: Each free build is limited to a brochure-style website of 5 to 8 pages. This does not include e-commerce functionality, booking systems, membership portals, or custom web applications.
  • Build timeline: Selected websites are built in a dedicated live build session, which may be filmed and published as part of our content programme.
  • Revisions: Each free build includes up to 2 rounds of minor revisions following delivery. Revisions must be requested within 14 days of delivery. Revisions are limited to text changes, image swaps, and minor layout adjustments.
  • One per business: Only one free build is available per business entity. Repeat applications from the same business will not be considered.

3. Intellectual Property

Upon completion and delivery of a free or paid website build, ownership of the website design and code transfers to the client, subject to the following conditions:

  • TFWI retains the right to use the completed website, including screenshots, descriptions, and build footage, for case studies, portfolio displays, marketing materials, and social media content.
  • The client warrants that all content provided to TFWI (including text, images, logos, and other media) is owned by the client or that the client has obtained the necessary rights and permissions to use such content.
  • TFWI shall not be held liable for any intellectual property infringement arising from content supplied by the client.
  • Any third-party assets (such as stock images or fonts) used during the build remain subject to their respective licence terms.

4. Case Study Agreement

By accepting a free website build from TFWI, the client agrees to the following:

  • TFWI may feature the client's business, website, and build process as a case study on our website, social media channels, YouTube, and other marketing materials.
  • TFWI may photograph, video record, and publish the build process, including the live build session.
  • The client may request the removal of commercially sensitive information from published case studies by contacting us at hello@tfwi.co.uk. We will make reasonable efforts to accommodate such requests within 14 working days.
  • The case study agreement is a condition of receiving a free build and cannot be opted out of entirely.

5. Paid Services

In addition to our free build programme, TFWI offers paid web design and development services. The following terms apply to all paid engagements:

  • Paid projects are governed by a separate project agreement issued prior to commencement of work.
  • Standard commercial terms apply to all paid services unless otherwise agreed in writing.
  • Payment terms: A 50% deposit is required before work commences. The remaining 50% is due upon project completion, prior to the website being made live.
  • All prices are quoted in GBP and are exclusive of VAT unless otherwise stated.

6. Content Responsibility

The client is solely responsible for:

  • Providing accurate, truthful, and lawful content for inclusion on their website.
  • Ensuring that all content complies with applicable UK laws, including but not limited to the Advertising Standards Authority (ASA) codes, the Consumer Rights Act 2015, and data protection legislation.
  • Obtaining all necessary permissions, licences, and consents for any content provided to TFWI.

TFWI accepts no liability for any claims, damages, or legal proceedings arising from client-provided content.

7. Hosting & Maintenance

Hosting and ongoing maintenance are offered as separate, optional services and are not included in the free build:

  • Hosting and maintenance services are billed monthly in advance.
  • Either party may cancel a hosting or maintenance agreement by providing 30 days' written notice.
  • Upon cancellation, TFWI will provide reasonable assistance to facilitate the transfer of the website to an alternative hosting provider.
  • TFWI shall use commercially reasonable efforts to maintain uptime but does not guarantee uninterrupted service.

8. Limitation of Liability

To the fullest extent permitted by law:

  • TFWI's total liability in connection with any free build shall not exceed the value of the services provided (which, for free builds, is nil).
  • TFWI's total liability for paid services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.
  • TFWI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.
  • TFWI does not warrant that the website will generate any particular business results, traffic, or revenue.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

Either party may terminate the provision of services under these Terms in the following circumstances:

  • Free builds: TFWI reserves the right to cancel or reassign a free build if the selected client is unresponsive for 7 or more consecutive days during the build coordination process.
  • Paid services: Either party may terminate a paid engagement in accordance with the terms set out in the relevant project agreement.
  • Breach: TFWI may terminate services immediately if the client is in material breach of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We reserve the right to update or amend these Terms at any time. Where changes are material, we will provide at least 30 days' notice via email or by posting a prominent notice on our Website. Your continued use of our Website or services after such notice constitutes acceptance of the updated Terms.
